(the "Association"), a homeowners' association organized and existing under the laws of the State of Florida, pursuant to Chapter 720 of the Florida Statutes (the "Florida Homeowners' Association Act"). These Terms of Use ("Terms") govern your access to and use of the website located at airpark.community (http://airpark.community) (the "Site"), including any content, functionality, and services offered on or through the Site.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not access the Site. The Association reserves the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on the Site with the effective date updated. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

1. Permitted Users and Access

Eligibility: The Site is intended for use by members of the Association (i.e., owners of parcels within Sandy Creek Airpark), their authorized tenants, authorized family members, board members, committee members, and authorized Association staff or agents. Non-members may view public portions of the Site but must not attempt to access any restricted areas.

Registration and Passwords: Certain features of the Site may require registration and login credentials. You agree to provide accurate information during registration and to keep your login credentials confidential. You are responsible for all activities that occur under your account. The Association may suspend or terminate your access if you violate these Terms or for any other reason permitted under Florida law.

2. Use of the Site

Permitted Use: You may use the Site only for lawful purposes and in accordance with these Terms. This includes viewing public information about the community (e.g., events, news, and general rules).

Prohibited Use: You agree not to:

• Use the Site in any way that violates applicable federal, state, or local laws, including the Florida Homeowners' Association Act or the Florida Computer Crimes Act.
• Attempt to gain unauthorized access to the Site, other users' accounts, or any Association records.

4. Official Records and Compliance

The secure portion of the Site serves as the Association's digital repository for official records, as required by Florida Statutes § 720.303(4)-(5) and House Bill 1203. These records are provided for informational purposes and to promote transparency. They are not a substitute for certified copies or official notifications.

You agree to use official records solely for purposes related to your membership in the Association and in compliance with privacy laws, including the Florida Information Protection Act.

The Association strives to keep records current but disclaims liability for any delays in posting or inaccuracies due to circumstances beyond its control.

Your use of the Site is also governed by the Association's Privacy Policy, which is incorporated into these Terms by reference. Public portions of the Site do not collect personal data.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved exclusively in the state or federal courts located or having jurisdiction in Bay County, Florida. You agree to submit to the personal jurisdiction of such courts.

10. Miscellaneous

Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force.

Waiver: No waiver of these Terms shall be deemed a further or continuing waiver.

Entire Agreement: These Terms, together with the Association's governing documents and Privacy Policy, constitute the entire agreement between you and the Association regarding the Site.
